Two Donley County cases were adjudicated by the District Court last week during docket calls in Childress and Panhandle.
The court met in Childress on Wednesday, September 20, with District Attorney Luke Inman, assisted by Harley Caudle, prosecuting for the state and the Honorable Judge Stuart Messer presiding.
Clayton Shields was placed on deferred adjudication community supervision for a period of five years for the third degree felony offense of unauthorized use of a motor vehicle, enhanced.
Shields, age 24 from Leila Lake, was arrested in Donley County by Deputy Ryan Hill for the offense that took place on July 2, 2017. Shields was later indicted by the Grand Jury on August 31.
Pursuant to the plea agreement, Shields is required to pay a $5,000 fine, $488 in court costs, and successfully complete 200 hours of community service. If Shields violates probation, he could face up to 10 years in the Institutional Division of the TDCJ.
The court also met in Panhandle on September 19 where Corey Mark Aragon was placed on deferred adjudication community supervision for a period of ten years for the third degree felony offense of evading arrest in a motor vehicle.
Aragon, 28 from Albuquerque, New Mexico, was arrested in Donley County by DPS Trooper Kelly Hill for the offense that took place on May 6, 2017. Aragon was later indicted by the Donley County Grand Jury on July 19.
Pursuant to the plea agreement, Aragon is required to pay a $10,000 fine, of which $2,500 was paid upfront, $488 in court costs, $853.80 restitution, successfully complete 200 hours of community service, and a $500 out of state probation transfer fee. If Aragon violates probation, he could face up to 10 years in the Institutional Division of the TDCJ.
Due to the fact that Messer issued a deadly weapon finding in the case, this offense is also a Texas Code of Criminal Procedure 42.12(3)(g) offense, which would require Aragon to be incarcerated for at least 50 percent of his sentence if adjudicated before becoming parole eligible.
