The district court heard three pleas when it met in Clarendon last Monday, October 5.
District Attorney Luke Inman prosecuted the cases for the State of Texas, with the Honorable Judge Stuart Messer presiding.
Dan Leon Clark was convicted for the third degree felony offense of driving while intoxicated, and was sentenced to ten years in the Institutional Division of TDCJ, but the sentence was probated for a period of three years.
Clark, 46, from Clarendon, was arrested in Donley County for the offense that took place on February 24, 2015, by Donley County Deputy Mike Spier.
Clark was indicted by a Donley County Grand Jury on June 22, 2015.
Pursuant to the plea agreement, Clark was required to pay court costs of $573, a $3,000 fine, $60.00 restitution, 200 hours of community service, and all DWI requirements under Chapter 49 of the Texas Penal Code.
Norma Ann Garcia was placed on probation for a period of four years for the second degree felony offense of burglary of a habitation. Garcia pleaded guilty and was placed on deferred adjudication for the offense.
Garcia, 33, from Wellington, was arrested in Collingsworth County for the offense that took place on August 7, 2015, by Collingsworth County Sheriff Kent Riley. Garcia pleaded to an information filed by the State on October 1, 2015.
Pursuant to the plea agreement, Garcia is required to pay a $4,000 fine to Collingsworth County, $376 in court costs, and successfully complete 300 hours of community service. If Garcia violates probation, she could face up to 20 years in the Institutional Division of the TDCJ.
Robert Lamar Tyus was placed on probation for a period of three years for the state jail felony offense of possession of marihuana. Tyus pleaded guilty and was placed on deferred adjudication for the offense.
Tyus, 51, from Colorado Springs, CO, was arrested in Childress County for the offense that took place on February 11, 2014, by Childress County Deputy and K-9 Unit Kenneth Arant. Tyus pleaded to an information filed by the State on June 26, 2015.
Pursuant to the plea agreement, Tyus is required to pay a $2,500 fine to Childress County, $329 in court costs, $180 lab fee, and successfully complete 100 hours of community service. If Tyus violates probation, he could face up to two years in the State Jail Division of the TDCJ.
